    Well... If 2 copys with the same ID are online at once you know the game has been pirated. So that wont cause any false positives. Can also test if the game has been played on > 1000 consoles, because no one has 1000 switches or friends with switches.

    Does this apply to homebrew games or any not for profit game development? I know they wont likely get sued but is there an exemption for people who are making there own game and want it exactly a certain way(or just dont want to or cant do the extra work)?

    Free speech means you have the right to say it without being locked up or killed, thats it! This applys to threats of violence too, your not going to be locked up for threatening violence, you are going to be locked up to prevent you from committing violence, the threat just gives probable cause...

    He said "send" a payload, that means data transfer, deja vu doesnt require data transfer. Its all on the device.
