Can you get banned? Maybe, since we don't know if $ony can detect if installed titles are "legit" or not.
Did they ban anyone for playing pirated games online? For now, no.

Actually, no, to be honest we no real way of knowning since we can assume is we did break the TOS or did something bad conciously but is all if sony does it manually by people or like google youtube bots do with random inserted data that get videos banned cause the robot is not working as expected. To be honest is just by risk. Somepeople still use PSN store with henkaku spoof and has not reported anything negative. What conditions cause a ban? well perhaps, cheating online, unfair play, exploits or maybe just being reported.... if there is a report button. If sony is too busy and left it to a robot. chances are still just as risky, you seen how googlebot handles youtube videos.

Sony has banned people on the PS3 due to pirating.
