Their downgrade methods, you tampering with their payloads, using fastboot for whatever reason and getting into sysnand and updating, managing to get it to think you are using a third party console. The list probably goes on, and some of this may be wrong, but meh.

Gateway doesn't brick people without them knowing even though it does have brick code in it.

It isn't going to randomly brick you, but you can read up a little and find out that their arm9loaderhax method isn't completely safe.

So in short, every brick with Gateway is avoidable by reading a little first.

Well... It's not unprecedented. 2 people were bricked by a legit Gateway in the past.
Really, all it would take would be a bad copy of their code to the SD card, and the brick code would activate, as it does a checksum on the file.

Highly unlikely these days. If you're a Gateway owner and you're not using "Gateway Fast Boot" you have nothing to worry about. If you're a DSTWO+ owner or an owner of one of the other clone carts, well, then you have a lot to worry about :P
Gateway Fast Boot itself seems to work okay, but the install process is not as safe as the homebrew A9LH method, and updating sysNAND on a n3DS with it installed will cause a brick (that's just due to the nature of how A9LH works on a n3DS, but they can prevent it by blocking FIRM installs)

@Swiftloke Their brick code was changed in 2.1 or 2.2, it's no longer so sensitive that a single byte wrong would trigger it. It would take major corruption and at that point the launcher.dat would probably not even work anymore. This was confirmed by one of the hackers in the 3DS scene (though not one of the biggest names as they keep most of their stuff private and don't like showing off as much as some)

The people getting bricked originally was due to the brick code being so sensitive that it had false positives, that hasn't happened since they fixed it. Nowadays the only bricks are from DSTWO+ users.
