They can always use CDNSP to download stuff they actually own. And then share NSP however they like. The only difference that they have to actually buy the game before releasing.

They designed whole cert infrastructure with fine grained per-device access control in mind, learning form Wii U mistakes. It didn't accidentally happens to be in place when CDNSP surfaced.

If they want to "protect" CDN they will just make online/cloud version of CDNSP: request title, grab it from the cache or wait for server download, single source of truth, no one knows how it works. Can even be limited to updates only to save bandwidth.
