The Firmware only needs to be within the 5.5.X range to use Tiramisu, however the latest update (if you did not delete the update folder) pops up a notification your wii needs to update the firmware. It is worth it anyway due to compatibility fixes from Nintendo themselves.

The Wii U wont install the update properly when you do this is what I have heard... I hear people are pressing update on the tablet and the Wii U with autoboot just reboots into the Wii U menu for some weird reason which is why people were suggesting to remove the autoboot

The 3ds Maplestory was supposedly not very cpu intensive compared to other 3ds titles so I will let you know what I find on this.
I didn't say a patch itself is illegal if it doesn't contain assets... Its illegal when it contains files stolen from the original game, or other licensed content from offline which is what some of these brawl projects have done and is a DMCA violation.

Yes, the game uses the disc license to verify the mod. This was and I think still is standard practice on the Wii, but the entire game and mod was redumped a few different times into corresponding isos for both the wii and wii u injection tool, you would just have to go searching for the files...
