Normal bans allow you to download firmware updates from Nintendo servers but not games/dlc/game updates etc. "Super ban" prevents access to Nintendo servers. Both types of bans still exist.

Safe to say Nintendo are gearing up to release their next piece of hardware. Will be mediocre outdated hardware just like the Switch. The next Nintendo gaming device will have worse native performance than a Switch emulator on a mid range PC running 4k 60fps.

Does not matter in the least. If Nintendo wants to shutdown Atmosphere they can easily do so. Developers of custom firmware, emulators, homebrew do not have the financial means to fight a giant like Nintendo, nor do they have the backbone.
This entire post is 💩. "Circumvention of copyright protection". Not really relevant considering Yuzu developers had nothing to do with the Switch being hacked. If that were the case, Nintendo would be going after developers of custom firmware.

There is legal precedent. Proper emulation is protected in USA. Yuzu developers were scummy. I'd not be surprised if Yuzu didn't contain bits of Nintendo's own code.
