Careful though, you might get an DMCA just for existing. After all, you do house tools and guides that "circumvent their technological measure".
I mean they visit the site. They can just dm Costello if they want something removed and so far I haven't heard they've done so.

Hi guys. I'll be taking my sys-patch repo down later today. My sigpatch updater is down as well as I received another dmca from Nintendo.
I hope the great work will keep on, in a less asking-to-be-bitchslapped-by-BigN fashion (i.e. not on github).

Yes, let's never buy their games again (only hardware if you know what I mean)
They probably couldn't care less since you are already not a customer. Buying their hardware is quite irrelevant since console maker business model is sell the hw at a loss, and bank on the software royalty. This kind of threatening is moot.

I agree except on one point: a technically outdated hardware sold ~€350 is not what I'm considering a "sell the hardware at a loss". Not anymore since lonce, at least...

Can we please stop using Github, owned by Microsoft - an US corporation? It is getting ridiculous at this point.

List of alternatives;
https://codeberg.org/ - Germany
https://framagit.org/ - France (by Framasoft)
https://gitee.com/ - China. Good luck taking this one down. Shitendo can't do sh*t against China
https://gitflic.ru/ - Russia. Good luck with this one also

GitLab is not an alternative, since it is US based.

I dunno how all this stuff works, but is the eu a good idea? Or alternative? I mean, when they want, couldn't they also just DMCA some repos hosted in the eu? Or is a DMCA just an USA-thing?

there is no DMCA process in EU, each country implements copyright law differently, specially in regards to having access to a copy of a legally obtained software.

"The European Union and each European country have a different "DMCA Takedown" process than the USA."
Source: https://www.dmca.com/FAQ/European-DMCA-Takedown-process

This sh*t works in America because it is the biggest capitalist country this world has ever seen. However, in Europe they must pay the loser's fees. With emulation being legal, it is a serious risk even for Nintendo.

PS: I'm not a lawyer

I'm not convinced moving projects elsewhere does anything because Nintendo can take them down just as easily (maybe not in russia or china but i would not trust these countries with anything anyway).

And besides that i have yet to see a takedown targeting sys-patch. The author took it down themselves.
