Bravo. You did well to cite this case. Here the judge acquitted him because the touch was so short. Evidently what makes the difference is the length, the grip, the strength of the touch, I presume. In Italy judges have a lot of freedom of judgment, for better or worse.
The problem just now on Spain is what the District Attorneys and judges are so influenced by social networking and the feminazis are making so big deal which put out of context everything and demand disproportional punishment.

Men, let's not be hypocrites! If even the mere impulse (drive) were judged a crime, we would have already been sentenced to life in prison several times. Certain sweet and rounded forms, constrained in tight clothes, are at first glance a strong temptation .............. but then reason intervenes to curb the instinct.

Sorry, German bluntness goes here: That is a nonsense comparison, @tentacleKrill! Touching somebody is not the same as killing. Choosing the most extreme exaggeration to dismiss this question misses the point.
What can be considered (sexual) harassment and what not – and is there something that can be called minor offense (compared to brutal rape). I'm pretty sensitive in this regard and have my own experiences with (non-sexual) violation of self-determination over the own body, but what is happening in this regard in the last few years is ridiculous to the point of mocking victims of cruel sexual violence.
If I wasn't that ugly I would maybe be afraid of getting harassed/offended/raped myself.
