If I were to port a free DOS game, such as Elder Scrolls: Arena to modern platforms, and upscale the graphics, would I be able to distribute it here?

It contains copyrighted code so nope.
Unless you recode everything then it's technically allowed.

Abandonware is a grey area but I think it's also prohibited.
