Because downloadable games you can't resell at the future. That said "historical footage" if we are going to have a copyright system does not sit wrong with me -- can't see why it would want to be excluded from copyright any more than a song/film/fiction book/... would be. Edit. Yes and no. Yes in that there will probably be a fair bit more of this when weapons, locations (copyright law, never mind "cultural sensitivity"*, gets tricky for this one**), cars, products... that are not public domain get included and the devs/pubs did not pay for perpetual rights (can be tricky, especially if you want to release enhanced/ports/remakes as what is new game and what is not is hard when doing that). No. Much like TV shows will rarely use popular music these days lest they be unable to sell it on DVD/syndication/streaming (see a lot of late 90s/early 2000s TV shows -- around here Malcom in the Middle and its first series not being on DVD in the US will probably be one of the more notable, though there are others https://www.vox.com/2014/11/3/7145231/shows-not-on-dvd-music-rights-wonder-years-wkrp vox I know but I could not find the one I want that went through loads, https://www.flavorwire.com/266733/12-tv-shows-we-cant-believe-arent-on-dvd https://www.wired.com/2005/03/copyrights-keep-tv-shows-off-dvd/ have some more) then games will probably adapt similarly -- right now I am reviewing a game with a bunch of "just changed enough" versions of real world weapons). Minor exception. If someone pulls their thumb out of their arse and sorts out the ability to resell downloadable games then you will probably see a bunch of sellers effectively buy up a considerable number of copies ahead of the deadlines and go from there. That or intense customisation is offered and people can recreate all their favourite weapons, vehicles, sportsball players, locations and whatnot and the devs can say "nah it is the users". I have seen some things heading down this path for driving games already. *which has been going on for a while now http://news.bbc.co.uk/cbbcnews/hi/sci_tech/newsid_2440000/2440713.stm being 2002 for Hitman 2. **US law has some oddities like buildings after a certain date, and fun with the Hollywood sign. Kinda silly. But cool I guess. Its like painting your 2by4 wood studs in a wall, before covering with drywall.

I heard a good one at the bar last night, made me think for sec. - "If you are cold, go stand in the corner, because corners are always 90 degrees."
