I can't believe I just got CFW on my 2DS.........

I thought I'd be doing away with custom themes, amazing SNES emulation, and piracy, but I guess I was wrong. The moment I realized I had a flashcart compatible with ntrboot, I went straight to the Guide. However, I don't want to risk getting banned. That last banwave that happened in May was what spooked me out of the 3DS scene to begin with. I read that I should turn Spotpass off and keep my friends list in the dark about what I'm doing, but what other things could I do to minimize a ban? I was thinking of giving Freeshop a try, but would I be putting myself at risk of a ban just for using it? I was also told that you should have wireless disabled on anything unofficial, but that includes Freeshop, doesn't it? I really need some help with this.

you wont get banned easily all u have to do is not play games early on wifi or cheat online thats about it

I've been banned without cheating or playing something before release. Out of region games also get you banned apparently.
 
Thanks! I'm still gonna be careful, though; it wasn't easy pulling my allowance together to get my 2DS.

Getting banned is over exaggerated honestly.The worst that can happen is getting a hyper ban which is very unlikely,even if it happens you can still get rid of it.The most common ban however is the console ban which basically bans your friend code seed from connecting to the Nintendo server,it's very easy to fix and you can find public ones that go viral.
 
@Ominous66521 There is no public way to remove a "hyper ban" that I'm aware off. (Error code 022-2182) You can only unban from 002-0102, which is the online gameplay ban, and the most common like you already said.

As far as bans go in general. As owner of 1 and a member of another 3ds unban discord, I can safely say.... We don't know jack-shit, lol. We have our suspisions, but since bans are so rare, its very hard to test for what actually got people banned. I still suggest turning off spotpass, sending info to nintendo, and showing friends what game youre playing for safety, but no one can guarantee thats enough to keep you safe, we simply dont know for sure.

That being said.... I agree with people here that you probably shouldnt worry about it. The only thing to fear is NNID related stuff like pokebank. If you care about that stuff, be wary of that "hyper ban." If you dont, you can unban yourself from online gameplay bans VERY easily.
 
I am in this EXACT situation. 2DS, just got cfw after sseing my card’s compatible, and now I’m playin injected vc games!
 
Who knows what criteria they go by to ban people. Maybe they have a dept that does it manually. I say this because I've always had my "share info with nintendo" settings on, spotpass always on, and even had homebrew as my fav title. I haven't been banned on any of my 3 3ds's or my 2 n3ds's. But then again, they could just be really pissed about pokemon, I never went online early and I never hack/cheat.
 
Well, thanks for easing my worries, guys. My SD card's only so big, so I can only fit one pirated 3ds game at a time, but that doesn't bother me too much. Link Between Worlds, here I come!

Disabling SpotPass and all that makes no difference, your currently playing title is still sent to Nintendo whenever you're online, people have verified that by sniffing the traffic.
To be as safe as possible from bans, don't run leaks, VC injects, out of region games or .cia homebrew while online. Stuff like FBI and FreeShop have .3dsx versions you can run through Rosalina set to Download Play, that way Nintendo only sees you as playing a legit title.
