Hacking Clear info on CFW bans?

I installed B9S + Luma3DS on my old 3DS to confirm that I could do it, and I'm now considering doing the same to my New 3DS (my data was transferred from the Old to the New 3DS, so the old one was essentially factory fresh, and has no NNID, titles, etc.). However, all my save data, bought games, etc. are on the New 3DS, and while I'm not to concerned about bricking it, I'm quite worried about it getting banned.

While I've seen some sources mention that the ban can be completely bypassed by disabling SpotPass telemetry and hiding your online status in the friends list, others suggest that Nintendos' servers can tell the legitimacy of the titles your playing/have played regardless of these settings, and that banning is only a matter of time.

To sum up my concerns:
-What specifically is used by nintendo to determine if a console should be banned?
-What methods do/do not allow you to bypass a ban?
-What actions should be avoided to prevent bans?

I'm aware that many CFW users have avoided the ban, accidentally or otherwise, so I know its' possible. I just want to be safe; I care very deeply about my 3DSs' online connectivity, and would be crushed if I lost access to that.

P.S. I have looked at this thread, which seems to be what most people link to on the subject, but its' rather confusing to read through and is highly speculative, which makes me concerned that some of what it mentions could be inaccurate, or that I'm missing important details.

Ban wave ended ages ago. Screw off with these threads already!
They could always do another one , you never know. In fact when Pokemon USUM is close to release, you can almost certainly guarantee there will be another one, especially if the games leak early again. So you really can't say that the ban wave ended ages ago, because Nintendo could always throw another wave out there.

I just got banned this morning, and I find that the biggest preventive measure is to not be online very much. I've been RNGing pokemon on two consoles and with very large frames to hit, I had to leave the consoles on for hours on end. So, I disabled wi-fi, probably something that you should do, and only enable when you absolutely need to. My bans so far have always been temporary, and it's not totally easy for me to avoid bans as I am almost 24/7 doing pokemon requests, thus requiring online time. I think I slacked off recently and paid for it this morning, being online through Festival Plaza a bit too long in certain periods.

if your worried about being banned then heres some stuff you can do

not alot of banns have been happening recently so you probably wont get banned

dont use ntr while online (your using luma so this is a big one!)
when possible use 3dsx homebrew (not sure if the new luma stuff shows it in friend list)
only set your favorite title as official games or sys stuff no homebrew
dont pirate games before release
try not to share localseeds (I got one of my seeds banned for this)
disable spotpass sharing
hide currently playing game if your using homebrew (not sure if this effects anything)
dont use obviously edited saves while online

ive been doing all of these and I only got my o3ds banned for sharing my localseed with my ex

I can agree with this 100% both my New/Old 3ds are still unbanned for a whole year. I installed B9S about 4 days before Sun/Moon was out and when I heard about the bans I disconnected my WIFI for about 1 week of the game being officially out.
Now I currently hide/inject Homebrew apps into the default useless 3DS apps to be the launcher basically tricking my activity logs. With the latest luma we can inject Homebrew launcher into any default app and just use 3dsx apps to stay undetected

There is always a risk of getting banned. Doesnt matter what you do. If its homebrew to cfw. Your still modifying the console against tos of nintendo. There is things you can do to lower that. but its never a definite 100%.

When modifying any system there will always be an inherent risk of bans. That's simply the nature of modifying your systems. This including all forms of hacking/homebrew/cfw/etc. all of them come with some risk of getting banned.
Of course the benefits of hacking is being able to unban yourself with relative ease.

To sum up my concerns:
-What specifically is used by nintendo to determine if a console should be banned? Some believe these were manual bans, where Nintendo collected information and banned users manually based on that information. But unless someone works for Nintendo, we don't have clear information on this topic.
-What methods do/do not allow you to bypass a ban? You can swap out your friendseed for one that hasn't been banned and modify the internal serial number as well. This will bypass the ban and let you go online again.
-What actions should be avoided to prevent bans? Turning off spotpass has been rumored to work. I actually purposefully got one of my systems banned to test this. Once it was banned, I swapped out the seed with a private seed that I had made from my 2DS. Then I repeated the previous steps to getting banned again, except with spotpass turned off. The system has yet to be re-banned since turning off spotpass.

You have a higher chance of getting banned if you regularly use homebrew CIA's b/c they get recorded into your logs. But b/c there isn't a definite cause of flagging it's never safe as lonewolf mention
Using Homebrew in an anonymous manner is our only suggestive choice and some common sense along with new games via WIFI activity

i dont trust the new luma hbl yet
you can goto the homemenu from any 3dsx so it might be sending weird data to ninty

The reason why we all should be using 3dsx over CIAs is that the HBL menu doesn't connect to Nintendo's servers or leave any logs behind, your undetected in HBL. Since my HBL is injected into "My Sounds" app
thats what will show up in my logs instead

It's also worth noting that the 3DS virtual console does something when connected to the internet (idk what tho), so I'd recommend not playing VC injects while connected to the internet.

I might be completely wrong, but you're not missing out on anything by playing VC injects online, so you might as well not do so.
