Been using LayeredFS to load multiple backups and still not banned, even forgetting to go offline at certain points. They've probably tagged me for a ban anyway though

OK this may also be important but I also have "Share Error Information" set to OFF. I'll add to the OP

got banned right now. Haven't played anything online. as a matter of fact, my console was offline since yesterday. well i couldn't careless, hacked consoles aren't meant to online play.

Go to Settings, and tell us if "Share Error Information" is set to ON of OFF ?

Idea. Why not ask someone you trust to buy a eshop game you want, but can't, cause you're banned, dump it, and share it for you to play, when Card 2 and eshop backups become a thing?

Can I ask what games do you played via layeredfs? Was wifi on while playing? Did you go some black screen error while using layeredfs?

1.- Donkey kong, kirby, little nightmares.
2.- On layeredfs i only used airplane mode.
3.- yeah, i got some error codes.

Looks like more are getting banned for using LayeredFS than SX OS.

The question then becomes did they use LayeredFS to load backups or JUST texture/game mods?

I'm leaning more towards users who used LayeredFS to load backups are the ones affected by this ban wave and not so much game mod users.

I used LayeredFS ~2 days after it was released and only played The Binding of Isaac: Afterbirth+ over Fallout Shelter.
I don't have any online games by Nintendo (Fortnite and the eShop still work) so how do I know whether I'm banned?

If those work, obviously you're not banned

That's what it seems like to me as well.

Try the eShop at least
I did and it works.

Some people who have been banned say they can still access the eShop. Also Fortnite uses its own Epic Games account, so I'm not sure a ban from Nintendo's services would prevent me from playing it.

Fornite goes through Nintendo's servers first before bouncing off to Epic's for account validation stuff so it'd still be affected by an Online ban, but your Epic account would be safe.

Then I guess I'm not banned yet.
I made sure not to boot with a modded joy-con in wired mode and I also enabled flight mode before entering CFW so if I'm lucky, I won't be banned at all. If that's the case then I think I'll wait for emu-eMMC before entering RCM again...

Logic tells me clearing your log could also get you ban potentially. If your log was uploaded to Nintendo when using your switch Unmodified, and they happen to keep logs of your logs, then next next you go online it upload your blank log = you modified your console = breaking user agreement = ban right...?

Well, I am not banned yet but expect it to happen soon... although I tried to be very careful. I only used Hekate once to load FIFA over Octopath Demo and kept the console in airplane mode the entire time. When I wanted to play Fortnite online I decided to remove as many traces as I could and thought of every possible way Nintendo may possibly find out what I did.
So before I went online again and bought FIFA off the eShop, I deleted the save data of the Octopath demo as I thought maybe Nintendo compares if the save data of a title matches with the title itself and they would notice Octopath has FIFA save data. Maybe that is a cause for some bans? (Mismatching title and save I mean)
Besides that, I can not think of any other traces I may have left, only thing is a 2001-0123 error log that Hekate caused when it somehow failed the console to boot, although I guess that's a generic error code that can also rarely happen to normal consoles when they have a hiccup while booting.
So again, atm I can still access eShop, Fortnite, log in to FIFA (which somehow retrieves Nintendo account data), play Mario Odyssey balloon stuff... let's see for how long
