Hardware Playing online with a 11.8 hacked 3ds

So according to what i've been reading, with 11.8 firmware Nintendo can now detect pirated games and ban the consoles using them. I read something about freeshop being useless now, since Nintendo now scans every title during installation and can detect pirated ones, so the moment those games go online the console gets banned. So, would that mean that if i installed my freeshop games months before this update they didn't get scanned and i could get online without getting banned? i also read something about games installed through FBI being safe to play online, since those don't run any kind of check from Nintendo, is this true?.
Also i haven't updated my console, i'm still at 11.7, not sure if i should update.

I was playing Pokemon UM online last night haven't been banned yet, I am on 11.7 not 11.8 though, the changes in 11.8 affect network install, so I don't really think it affects online play. There was a case of someone being banned with things related to Pokebank and 11.8.

The checks only occur at install time while downloading from their CDN (like freeShop does), and the checks that actually send console info that could get you banned occur while using the NIM module, and that module is used on sleep downloads.

In short, previously downloaded games are fine, and installing not-blocked titles (here is a list) not on sleep downloads is fine too. Nintendo now uses the new requirements on almost all games.

The FBI thing you misheard is for when all (or most) titles are blocked by Nintendo and you can't download them through freeShop. When that happens you'll have to look up the .cia of the game and install it through FBI. That moment is here.

Playing online is fine, except for cheats and unreleased games.

I recommend updating, as you won't lose anything. The changes are made serverside, so staying on a lower firmware version doesn't help.

I see, so as long as i don't cheat or download games while in sleep mode i should be fine. Thanks for the quick reply.
