Yep, they took down both VVVVVV and Citizens of Earth.

They don't remove it if it isn't a small third party game.

This is Badge Arcade we are talking about, a "game" maintained by Nintendo itself. If there's a vulnerability, it would be patched in no time.

there is an anyversary thing going right now
you have 2 free plays and they are cicling badges every day...
it's a micropay to microplay system
there are "wall of fame" with custom rabit text with constantly new frames
so yeah.. i bet there is a dedicated team dealing with the game almost every day that will most likely patch it in like a couple of working hours

unless the said vulnerabilty has to do how the game goes or communicates with the home menu and they need to realease a new firmware in order to patch it

As of now he isn't and this is just going to become a breading ground of memes if it stays unlocked for 8 more hours. I would pull a locked until further proof.
