This is being developed in Unity for New 3DS. I am allowed to discuss this here because Super Mario Kart 3D is made in Unity and was made thread for discussion here.

I already have the player part done but the maker is harder

I started work on the maker part but it is pretty hard to do in unity

I think Mario is a copyrighted property, that's kind of tricky.
I can't answer that with certainty tho

She's using Unity for the 3ds, which you can get access to by signing up for the Nintendo developer portal.
