Can I get banned with CFW? (I think I know the answer, but just looking for reassurance)

I want to use the pokemon picross method to install CFW on my 3DS and as far as I know I can go online even with games I download from the PC and install with FBI based upon my research, but I'm just hoping someone can confirm that for me before I go ahead and try to use the 3DS online after installing CFW

my 3ds has been modded since 2019 and to this day its still not banned and my old 3ds was modded since 2017 and that afaik is still not banned

Just don't use cheats online and you should be good, and even cheating online doesn't tend to cause bans these days afaik, Nintendo's basically forgotten the 3DS by now.
