Hacking Format preowned N3DS XL on 9.8 without updating?

Hi, I just got a preowned N3DS XL on 9.8 that I bought to downgrade and install CFW.

It's got the previous owner's NNID and all his stuff on there. I want to format it, but it's asking to connect to the Internet. Is it ok to do this? I'm scared it's going to update it.

The purpose of connecting when formatting, iirc, is only for de-linking the NNID. It shouldn't do any updating.

if you that paranoid about it. hack it first, then format since luma3ds will protect the firm.
