What exactly should be "illegal" here? The coder did not implement anything copyrighted.
well they have the old gameboy clause by embedding the Nintendo 3ds logo in the boot screen, this was bypassed by the homebrew launcher which proves it's possible, but most (AFAIK all other homebrew) just skip this and embed the Nintendo 3ds logo, plus AFAIK he just re-textured the official eshop banner... so there is a few enfringements....enough to get it pulled directly

the apps also used for piracy so that another reason to it illegaly downloads games off nintedos servers it does not have the urls in it for that but its easy to find them by googleing

So games already cache should still be able to be downloaded? If that's true then its still pretty OK. The 3DS doesn't have too many new games coming out other then Yoshi, pikmin and Dragon quest off the top of my head.
Yes, the app should continue to work for any game currently in the cache.

It does not "illegally" download anything, Nintendo's servers have no protection, the files are publicly accessible, there's nothing illegal about accessing them.

I dont know if freeshop actually does that but the key word is "believes". I dont think they can do that.

The app can download games off nintedos servers for free its piracy even though it does not download them unless you put the title key site url in the sites easy to find and most people use it for pirateing

Wow. Its just another way to install cia files. Just download them off that iso site and done. Not really worth the effort Nintendo.
