Gamevice to take Nintendo on again over its patent, in attempt to ban Switch sales in the US

Not sated with having already lost to Nintendo multiple times in the past, Gamevice is back at it again. This time, they've filed a yet another new patent infringement complaint against Nintendo, alleging that Gamevice's patent on attachable game controllers was infringed on by the Nintendo Switch and its Joy-Cons. Not only that, but the company has also appealed the case they lost earlier this month, when the United States Patent and Appeal Board threw out their case, deciding that a company can't patent controller devices that clip on to tablet-like hardware. According to the US International Trade Commission, the complaint was filed under the Tariff Act of 1930, which would prohibit the sale of imported products that infringe upon a pre-existing American patent, meaning if Gamevice is somehow successful in their goal, the Japanese-created Nintendo Switch wouldn't be able to be sold in America. From here, it's up to the USITC to decide if the case is worth investigating, where we might see another months-long court battle kick off once more.

patents should forever expire 10 years after a product hits the market. copyrights on video games should expire too after 20 years of age and have to go open source
You can thank Disney for making the copyright lasting a long time. Trying to keep their characters from entering public domain.
Then there is an issue with trademark as they could classify Micky as their trademark thus preventing the public from using the character.
I could be wrong on that last bit though.

you cant win this case if your allowed to win then that opens up law suits agenst other split controllers that are made for disabled people and that would be causeing problems for laws agensat people with disability discrimination

Meh, I mean ... Maybe they are doing that because they think they can get turn this into their advantage and have a deal with Nintendo ? Or maybe I'm just thinking of that because I have just seen an episode of Better Call Saul a few minutes ago ... I can't think of them being so naive they could get something like "ban the Switch from US stores", they must have something behind their mind. Or maybe I'm just over thinking, who knows

the only way they can win is if the mob "disposes" of the lawyers pre trial as mush as i commend them for shutting down switch sales it's hopeless they'll just go bankrupt

I think the headline should read:

Gamevice to take Nintendo on again over its patent, in a last ditch attempt to get some sort of settlement payment by being a pain in the arse.

But good chance they'll just be left with lots of court fees

This kind of action is economic cancer like many thing that plumb the system. I don't want to live in stoneage but why not just to fuck up all those people looking for money and likes.

It'll get thrown out. Probably even have the trademarks invalidated. Clip-on controllers are as old as time, the Switch's only new innovation on that end is bringing one to mainstream consoles.

A trademark needs to be consistently upheld for it not to fall into common use, in which case it becomes invalidated.

Again? Just how many lawsuits do this guys want to lose? Wireless remotes shouldn't be a valid patent, they have existed for like 80 years or something!
