Technically yes but since it's no longer published or being sold and the company is likely out of business then there's not much chance of you getting in trouble.

Microsoft is out of business? That's news to me.


So GBATEMP nor those sites, will get in trouble, by sharing it. Also GBATEMP is illegal in some countries, too, so why are they still online?
GBATemp has to obey US law, not North Korean law.

Could a md5 hash of the file in question be put here?

There is a project for running win 98/95 on the new 3ds in this site isn't there?

Technically a md5 hash or any other hash is a derivative work and thus is also copyrighted the same as the original work though given a hash is such a small part of the original work and is one way it would probably fall under a fair use defense.
