Is it illegal? Probably. Does ninty care? No. I've downloaded multiple versions of the Wii SDK to set up an NDEV that I have, and the swat team hasn't busted down my door yet.

I guess it's the same as downloading any other pirated program, but in this case, you are not stealing anything in terms of money, however you are getting software that was only meant to be obtainable with an NDA. It's the responsability of the leaker for breaking it.
