So is this just a game incompatibility or is there a certain type of game or function of a game that hasn't been patched to work with Gateway? My worry with gateway is that one day when the money stops flowing in we're going to stop getting updates that support newest FW and games.
You forget that any changes gateway makes to the firmware, don't persist after reboot. How exactly would a homebrew launcher - run from GW card, or installed - work without launching into GW mode first.It's very easy for Gateway to patch the NCCH signatures but in that case it would be very likely that someone writes a homebrew loader which doesn't require the red card any more.

So you're suggesting installing untampered games to the SD. Fair enough, the NCCH would be valid, but they still would not load. The 3DS checks the title's ticket stored in the NAND before launching a title. For all currently released 3dsware, the tickets have been false signed.
