I think the problem others are having is that they used the "hacked" sav file that was uploaded for others to use. but that sav file is also a incorrect file size. LoZ:ST uses a 1MB sav file.

Not really: even clean rom has the problem
I never used a hacked version of zelda and it was working fine with 1.44 3rd revision (water temple already passed).
1.45 system update completely deleted my save game

You misunderstood me. I was using the Clean rom and a blank 1MB sav file I made my self to start LoZ:ST, while most others used the clean rom and a 979 KB sav file they downloaded called a hacked sav file.
I just loaded a 979 KB sav file I made with desmume (that is where the hacked sav file came from). When I launched it with M3 Sakura 1.45 there was a beep and a message about an automatic sav file conversion. when it was finished, the game booted but all the sav data was gone. When I loaded my self mad 1 MB file on 1.45 for the first time, there was no beep, no auto sav file conversion message, and the save data was not deleted.
