If the seller doesn't mention that the console has been banned, I'm sure the buyer can return it. Besides, I think that Nintendo doesn't care if you have bought a banned console.

i mean, you'd think so, but how many would go for that kind of legal struggle to return something that was bought privately? i mean, if it was over ebay or amazon, ok, but these will be all over craigslist and whatnot.

Nintendo will always know if you bought that game or not. It's linked to your account (on their servers).

Doesn't matter where you got the data on your console from.
Dammit, i miss the wii u era when you can grab game directly from the nintendo servers and play it online totally safe, a dream cme true.

Buying something private is always connected to risks. That's why I would never buy something on suspicious sites or from dodgy sellers.

This is a good thing especially for people who legitimately buy games: this will potentially ban any CFW from cheating then ruin other people's online experience.

If nintendo have you to pay for online, then the least thing they can do is ban any cheaters who run CFWs.

If you want to play online-games, use sysnand and purchase your games.

If you want to play backups offline and use homebrew, use emunand and never go online while on emunand.

maybe one sdcard for offline and another for online

Well you would still need to go online if you wanted to get updates for your backups

Unless there is a way to get them without connecting to nintendo servers

Also if you go online with a cart that has a banned cert you are going to get banned yourself.
I have to question this one. What if a pirate gets his hands on a copy of Dark Souls via Gamefly or Gamestop, and returns it after dumping the unique header cert thingy. Then someone else buys the game or rents it via Gamefly, and both go online at the same time? Is Nintendo going to seriously ban both users? One is completely innocent!

Well, that's something that Gamefly or Gamestop have to deal with. But the possibility is there.

It's an interesting conundrum for sure. Will be interesting to see how lenient / strict Nintendo will be here but they do have to balance it out somewhat. I'm sure they'll be able to spot pirated games a mile off (like the BBB dumps) so it's likely they'll just blacklist the 'obvious' ones. Having said that no one can be sure but at least they have the technology and implementation to combat piracy this time round. And so they should.

I guess they wouldn't care about that. But GameStop has the name of the pirate and if you get banned they will contact him for sure.

The BBB dumps are already "cleaned" so they can't be used online anyway. Since the cert doesn't exist on them.

If someone innocent does get banned for playing a used game that has been dumped from a cart and is currently being used by a previous owner beforehand, I can't imagine Nintendo unbanning the console so easily. :(

actually i 'm very concerned about a little question: even if you buy a legit cartrige and play it on sysnand, is nintendo still able to detect ur installed Emunand?

You must have misunderstood me. Nintendo won't unban either of these guys. But the pirate will probably get in trouble with GameStop for selling a game which he backuped before.
