@dpad_5678 DSiWare cannot be legally obtained except from Nintendos servers, you were telling someone to download something by means they cannot do so legally, backups are only legal if made by your own media, and digital media is technically a license for as long as you can obtain it, you can't legally obtain those DSiWare except off the 3DS eShop, you are arguing the fact he was downloading something illegally because he paid for it from a service that no longer exists, it doesn't work that way, I hate to break it to ya. And no you didn't provide links, you explained in detail exactly how to pirate, that is no different from me saying "hey, google this, and scan that after hitting this option in this one app" is literally what you did. And by admitting to it inside our server, you admitting to breaking our rules, which was grounds for the ban since you managed to break many rules and still not abide by them. So you are right, our rules don't extend to DMs or outside of the server, but you admitted to breaking the rules inside the server.

I think maybe you just misunderstood the rules and/or the point of the rules.

The general idea of these anti-piracy-assistance rules is to prevent the Nintendo Homebrew Discord from becoming a catalyst for getting help with pirating Nintendo console software. While for many, attaining homebrew is only a tool that aids you in a quest for piracy- this is simply not the intent of the Nintendo Homebrew discord.

There's two reasons for this. Discord itself is not a platform that is kind toward extremely large servers that do not adhere to their terms of service.

For GBATemp, yes, it's OK to talk about piracy tools such as freeShop because GBATemp is an independently ran website, they have their own rules and can put up a fight legally if needed.

Discord on the other hand, is not. They have terms and guidelines to follow and if people at Discord don't like you, you lose. End of discussion. If Nintendo were to begin making a fuss at Discord over this server because it aids piracy, which is irrefutably illegal in all contexts, This server is gone in an instant.

Discord has a terms of service, and the larger a server gets the more strictly you need to start following these terms or you run the risk of the server being banned. Here are some relevant quotes from the Discord Terms of Service.

As an example, you agree not to use the Service in order to:

• violate the contractual, personal, intellectual property or other rights of any party including using, uploading, transmitting, distributing, or otherwise making available any information made available through the Service in any manner that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity);
• exploit, distribute or publicly inform other members of any game error, miscue or bug which gives an unintended advantage; or violate any applicable laws or regulations, or promote or encourage any illegal activity including, but not limited to, hacking, cracking or distribution of counterfeit software, or cheats or hacks for the Service.

As you can see, Discord already has a pretty anti-hacking attitude towards the public anyway, making the whole Nintendo Homebrew discord itself already riding the line as it is. Unlike smaller discords like GBAtemp's and that Chaos site's, this discord is considered by many to be an extremely valuable tool for helping people get, at minimum, homebrew access on their Nintendo consoles.

Outright admitting to piracy and assisting in it is a surefire way to not only get Nintendo to notice and get in contact with Discord about it, but also to be setting a public precedent for supporting what is irrefutably an illegal activity, which breaks the Discord Terms of Service.

And for a server that has had over 30,000 lifetime members to date, would obviously be a great loss to both the community at large and anyone interested in modding Nintendo consoles for the foreseeable future.

So ask yourself again, is allowing this Discord to publically become a catalyst for piracy really that good of an idea? Because I don't think so. Based on Discord's terms alone we should consider ourselves real fucking lucky to have what we've got.

So...are you going to actually bring this up to a staff member, or are you just going to write about it in your blog? I mean, that's fine if it's the case. But, if you want answers, I would suggest actually PMing a staff member. That would get you a lot farther than calling a member of the staff "butthurt".

Nobody is going to join a Discord server where you ban someone because you don't like them. That's bad moderation. Say what you will about NH, but the mods there won't pull bullshit like that.
