Hacking Discussion Technical Question About RomFS and Nintendo Account

I KNOW WE DON'T KNOW ANYTHING ABOUT BANNING YET JUST WANT TO SEE SOME PEOPLE POINT OF VIEW ON THIS SUBJECT

Background:
So I link my switch to my NintendoID because I wanted to download some demos to use for LayeredFS. After successfully setting up Layered and spending a couple of days playing backups I notice that that in my profile page under Play Activity it has some title spots that fail to load. For me it has 8 "loading failed" spots. That got me worry so I wanted to unlink my NintendoID from my switch. However after trying it in LayeredFS and Horizon it gives me an error. I cant unlink it. I being using the system offline for the whole time until today when I try to unlink the account.

Question:
Since my NintendoID is connected to my console it must have the serial number of the switch store somewhere. Since I am unable to disconnect it, the only solution would be to format the device and get rid of it. If I do that and get a new NintedoID. What do you think about the following

1. What are the probabilities of them banning my device with the new account?
2. If I use a new account do you think there would be records of me using homebrew and backup at all

1. If they ban, they ban both, so same probability.
2. Yea. Under your old account and your switch.

For 1.

Even if you format the console.
Also what would they do if someone sell the console not knowing it was ban and the new consumer receives it. Could you technically fight since its not the new persons fault and they had no idea

Once the console is banned, it can't be unbanned (currently).

This is the same scenario as being sold a used game that has a banned header/certificate. Nintendo isn't responsible for the sale of used games/consoles. That responsibility is left to the buyer/seller. Now that doesn't mean you can't make the case to Nintendo and call them to ask to unban your game/console. But the chances are pretty slim unless you've got a good story.

Ninty can/could unban...however they would never believe your story

Can, but why? "I don't know" means nothing...

This is the same scenario as being sold a used game that has a banned header/certificate. Nintendo isn't responsible for the sale of used games/consoles. That responsibility is left to the buyer/seller. Now that doesn't mean you can't make the case to Nintendo and call them to ask to unban your game/console. But the chances are pretty slim unless you've got a good story.

Base on the answers then everyone who uses homebrew or backups could be subject to a ban since there account needed to play the demos. Is there any scenario that a person could be safe?

The only two ways to never be banned is by staying offline all the time or by never doing any unauthorized modifications to your system.

But how can you stay online if you are running cfw. You need the demos to run LayeredFS and that information like play time had to be recorded somewhere.

If someone were to provide dumps of the demos and we had access to a theoretical title manager, you could install the demos offline. However by that point, it would be easier to install the games. This is why LayeredFS is not an effective way of running backups and will most likely be replaced by a method that is inherently designed towards running backups.

Well it not possible to run any games even demos without an account. Even though I wasn't able to remove my account it ask me to sign in to my main account to play the demos.

Yah I'm yet to experience that. Wouldn't blame you as that would be extremely concerning. But that's also why I don't connect to the internet if loading backups.

But by that point, you can just skip the LayeredFS step and just install the game of your choice. You cannot safely use LayeredFS and play backups hence LBL will be replaced by a much safer and more effective way of launching backups.

Yeah maybe it a loading issue with the accounts after all because this is my second switch. In the previous one I use to play mario kart, Splatoon, Zelda before selling it

I don't think there is one and yeah at that point layeredFS would be obsolete
