Modern copyright takes 70 years past the author's death to expire.
No modern videogame's copyright has expired.

To note the topic, Jazz Jackrabbit 2 is from 1998, so it's copyright won't run out for quite a long time.

The only reason abandonware is free to download is because there is nobody left that will actually press charges and issue the takedown notices.
If somebody did decide to, they could easily fine you because the copyright is still in effect, it is still illegal to download.

Saying abandonware is legal is like saying killing is legal if a cop doesn't see you.

I haven't played it for ages... It was a fun game though, both Jazz games were. The 3D one in the Unreal Engine looked pretty promising too, it's a shame they never completed it.
