Factory resetting doesnt clear logs they STAY. Hekate though has an option for clearing logs, but probably not fully

Which logs are we talking about error logs ?

Make sure you are aware of the following before restoring your console to factory settings
Restoring the console to factory settings will delete all data, and you will no longer be able to use data saved on a microSD card.
  • The following types of data, saved in the system memory, will all be deleted:
    • Software data
    • Save data
    • Screenshots
    • User information
    • Nintendo Account link
    • Registration of your console as the active console for downloads for your Nintendo Account (only when connected to the internet)
    • All settings on the console
    • All information records such as error history

On my last console I remember running devmenu and noticing something like logs, activities or crash report and seeing titleid's i never used before. I also remember making a mental note that this will surely get sent to N. sure enough that console was banned. I literally restore day 1 nand every time i want to go online as I feel like they are receiving data even though I opted out. Their is something going on behind the scenes.
layerdfs and devmenu seemed to be what got me that result

RomID is not the TitleId

Every Game, Dlc and Update has an unique RomId, this is a sha256 hash generated from the SDK, it is stored in the *.cnmt file, the SDK calls it "Digest", DevMenu calls it "Rom Id Hash"
It is unknown how this value is generated and of course Nintendo can see this value.

The DevMenu.nsp floating around uses a RomId generated by the leaked SDK and of course this value is not present in Nintendo's DB, so -> illegal ROMID.

I have DevMenu nsp installed. I have not been online since I installed it. I have never used it or even opened it, but it is installed.

Am I screwed?

It is unknown how the RomId Hash is generated, it is possible that this is a runtime hash value.
So running DevMenu or any other app via layeredfs may cause to break the RomId Hash -> illegal RomId.

Also layeredfs is the main reason to get banned on Switch....

I believe version 5.1.0 to be their ultimate anti-hack firmware.
They are able to collect all sorts of data once you go online with it.

I believe version 5.1.0 to be their ultimate anti-hack firmware.
They are able to collect all sorts of data once you go online with it.
A newer update is always built on top of an older update while improving itself so no that's not how it works

but if you only play XCI on SX OS and then reboot to normal FW and use only legit games online then i see it being a safe as you are going to get
That's what I do, and I don't clear my logs anymore. I use TX OS for emulators and pirated games in airplane mode, and OFW for Splatoon 2. Still not banned. I've also never updated any games, legit or not, within TX OS... Always install NSP updates for them instead. The only time I update my legit games is by putting the cart into the system, then updating the game in OFW. And I never "accidentally" try to launch pirated games from the OFW launch screen either.

Just to say... When people are reffering to logs, please specify weither those are crashlogs, playlogs,etc. (even tho i know most of them are crashcrashlog bur still)

Also,crashlogs in particular aren't suspicious if you don't have any on the actual system ( and you didn't delete too)
