You can buy ANY New3DS on the market atm and then just wait for a stable build. To my knowledge no new in box system should even have 10.3 yet and this method will work on any system with 10.3 or lower.

I know new in box systems come with up to 9.9, because the new Hyrule Gold edition N3DS has 9.9 on it.

Keep in mind that at this time, regardless of what system version you start with before the downgrade, you cannot update emunand past 9.5 for a N3DS.

Look for the thread "CFW for n3ds without OoT or CN" or similar.

As for preinstalled/download code, looks like it is different by region. The Aussie Yokai Watch bundle is definitely preinstalled. I am tempted to buy one and dump the legit CIA but can't really justify the $130 or so :-/
