Hardware Dsiware transfer

So, I have a friend who has cfw, and he has a bought wario ware snapped on his 3ds (not on the cfw). I thought I could transfer his dsiware onto my 3ds so I can do the dsiwarehax downgrade. Would that work? And would he loose his cfw?
