Error 13 after upgrading HDD on a chipped XBOX.

Hi,
I have just upgraded the hdd of my chipped xbox but it has like a 50-50 chance of going into the mod(with the evox logo).
When it does boot up with the evox logo, everything works fine. It does, however go to the error screen when it boots up without the evox logo.

It used to do that 50-50 chance even before upgrading the hdd but it goes on to the stock ms dashboard. Now it just errors out.

I understand error 13 is a "missing dashboard" issue and could be fixed by loading a retail game. Unfortunately, I don't have one.

BTW, I used Hexen 17 to format the new hdd, install apps and dashboards.

Any way I could fix error 13 and the apparent luck based mod booting issue?

Tested that HDD before putting it in the xbox and it works fine when it boots in evox so I don't think it's the health of the hdd.

The 50-50 chance of booting in modded and unmodded mode has been going on since I got this(with the stock hdd).

I could also press Start before turning on the system and it would boot evox mode 100% of the time.
