Nintendo sends DMCA notices for "syspatch-updater" homebrew app by iTotalJustice

Nintendo is back at it again with their latest and most well known franchise, the DMCA, and this time they went after quite a handful of GitHub repositories with their DMCA strikes.

The latest and most notable repository attacked by Nintendo's DMCA is the "sigpatch-updater" homebrew application by iTotalJustice (alongside all of its forks) just a few days ago. This isn't the first time for iTotalJustice however, since he got another DMCA takedown previously for the standalone "sipatches" repository before back in 2022. The application worked as its title implies, by basically updating the signature patches from within the Nintendo Switch console itself. This seems like yet another instance of Nintendo trying to stomp on any kind of possibility to run unsigned software on a homebrewed Nintendo Switch, be it actual homebrew applications or pirated ones. Even though the source code is down, the patcher itself seems to still be hosted in other websites, alongside other DMCA taken-down tools.

Unfortunately, "sigpatch-updater" isn't the only software hit with the latest attacks by Nintendo and its crusade against copyright-circumvention tactics, as Incognito_RCM by ScandalUK (this one still being live at the time of writing), kezplez-nx by shchmue, and another fork of Lockpick_RCM by SpaceNX have also been the target for Nintendo's DMCA, adding up to the instances of Nintendo going after homebrew projects for the Nintendo Switch, with one of the first reported being the original Lockpick_RCM, which got being taken down last year with a DMCA notice by Nintendo's lawyers, claiming the same copyright circumvention tactic.

With all of the current legal events taking place in regards to Nintendo both in regards to homebrew apps and Switch emulator Yuzu, it's most likely that they will continue to scour the internet and GitHub repositories for any kind of semblance of alleged copyright-circumvention methods, applications, or even guides to dump Switch keys of any sort. The legal clarity regarding fair and personal use when it comes to copyright-protected technological devices are still unclear to make any kind of counter-claim against their DMCA notices.

One new/remastered game every six months at this point, but one new DMCA every three days. Clearly Nintendo's true calling isn't in video game development any more.
They rather spend the money paying their lawyers than spend the cash in developing competing hardware instead their moto is head to the dumpster to find the least capable shit and call it innovation.

Yeah, nintendo could pull the same thing that they did with Gary Bowser. And IIRC the Nintendo Ninjas already know about SciresM and one of his Switch systems was one of the first consoles to get banned for “unauthorized modifications” (which is what later led to the 90DNS blocking trick that became more of a mandatory step in the modding process)

Also he would be another case of a “kill two birds with one stone” since he’s also responsible for helping ProjectPokemon and PKHex.
90dns is not really important for homebrew only usage, and wasn't in a long time.
The result of the early bans was more, that the fatal and creport system modules got reimemented, to reduce logs send to Nintendo.

Also keep in mind that as far as I know SciresM is a lawyer himself, so he might not be the easiest target with a wonky case, especially since he stays away from signature patches and keeps the copy protections intact with atmossophere.

If they truly wanted people to stop hacking their systems, they'd stop putting SD card slots on them. Just bake in a 512GB soldered eMMC and be done with external storage. And don't include a web browser to run webkit exploits, for fuck's sake... They're being so STUPID about it.
All cfw allowing entry points we have on the switch are faults in the bootrom made by nvidia, or stuff that nvidia didn't document.
So no sd card and no interpreter only webkit (no jit in the switches webkit, which is why the eshop performance is not that nice) would not make a difference at all.
The only big flaws we had, where the the once with 3.0, where we where able to get privileged system module permissions, which is below trustzone and kernel and was allowing us to load homebrew and have general code execution. This wasn't enough fo cfw in itself through, without combining it with a bootrom flaw.
There also doesn't seem to be any exploitable bug in the kernel or trustzone, while SciresM seems to even have a browser zero day, he could drop in the unlikely case someone finds a way to get kernel or trust zone level execution (though it would be dumb to drop anything now before the switch 2, instead of waiting for it, since the switch 2 will use the same base sdk and OS).

Nintendo could probably even allow limited execution of homebrew software officially, without breaking the system security to a noteworthy level, but they are playing safe.

Nintendo is the only one actually cutting off features from a system that the previous one had, just look at menu themes, web browsing, video/audio playback, 3rd party apps of any sort (and no, Netflix and youTube doesn't count, since Nintendo can kill those off like they did for Wii, 3DS and WiiU).

That is not accurate whatsoever. There are plenty of features from prior Xbox and PlayStation consoles that Series X|S consoles and PS5 users have been begging for since release. Just a couple of examples are no themes, folders or standard web browser on the PS5 & no snap feature on the Series X|S.

If only they put as much effort in researching new hardware and game ideas instead of recycling the same old shit over and over.

I cant believe they even managed to get away with claiming over 2million in damages over a emulator that had fuck all to do with their shit attempt at ensuring its own games aren't leaked early.

Or, was this done intentionally knowing pirates will pirate it and of course it had nothing of a challenge for any emulator to run the game and then nintendo can steal monies off the peeps behind the emulator.

Something nintendo have always hated simply because emulators prove how every fucker in the world does everything better than nintendo.

They'll ensure to see this shit title been emulated shut down, god forbid the world seeing nintendo re release it again for its next shit last gen revamp console with the improvements the community already made possible on the existing game version, without having to buy their new system.

We should be entitled to fuck nintendo back for constantly ripping the console market off with their constant refusal to rectify their shit joycon analogue sticks.

We should be entitled to fuck them over when they keep releasing games that have fuck all to them, basically crapping out empty games with nothing to do, just them cashing in releasing a demo to then later actually bring the content as dlc or as TOTK, the features they wanted to add was so much they figured why not charge full price..... ohh wait increase price as next gen consoles did, yet shitendo gave you fuck all worthy the price increase.

That's just it. With Miyamoto in such control, he actively ignores franchises he himself doesn't care for, regardless of interest or marketability. It already took a Herculean effort on the part of Nintendo of America to greenlight the Prime 1 remaster, entirely because METROID MAKES MONEY HERE!

How much longer is he also going to ignore f-zero? Or any other franchise that were done better by outside parties? Donkey Kong was blessed by Rare, along with Goldeneye and Perfect Dark. F-Zero got its penultimate masterpiece with Sega. Argonaut and n-space did Star Fox better than Nintendo itself did. And because of that, Miyamoto is being all butthurt because he is pants shitting terrified of his final game being perceived as a flop.

Though given what happened to Gunpey Yokoi after the Virtual Boy, there is good reason to fear Nintendo's wrath.

Plus 90DNS was used early on before better alternatives were made. And since this happened in 2018 (when the Switch modding scene was still brand new), 90DNS was all they had that didn’t involve wiping/hiding serials and/or messing with the nand itself.

Giving an update on their next system
Adding themes to the Switch
Improving their online
Actually having content for their online that warrants the price
Improving the slow and clunky eShop
Working with their second party studios, like GameFreak, to ensure better quality games

I know Nintendo’s legal team isn’t part of the gaming section but they are on the payroll and have been doing way more than the gaming section of Nintendo
Anyways, you should pirate Nintendo games. Clearly they aren’t using any of that money to improve as a company

They did give us F-Zero. It's called F-Zero 99. Yes, it's a shitty battle royale, but Nintendo behaves like the monkey's paw. When we asked for folders, we got them in the most obscure and half-assed sense Nintendo could implement them.

I would sell my kidney just for a little Animal Crossing NH attention from Nintendo. I really expected more from them. Instead, we got a half hearted update before Pokémon BDSP got released, which completely killed the game. But sure, the Big N can focus on their legal team
