You incorrectly paraphrase and then comment how dumb it sounds. Do you know how dumb that sounds?

How would you know there aren't people complaining directly to Nintendo? Even if they're not, complaining on public forums and social media might me more effective because Nintendo can read that too. They have even more incentive to take what's said over there more serious than a few emails.

Because while everyone likes to complain, no one stood up and said "I brought my complaints to Nintendo".

I'm not justifying piracy here. Thing is, even if all the reasons I mention wouldn't be an issue, I still have no moral issues with piracy in most cases.
Pirating is not like shoplifting or stealing. You make a copy, you don't remove the original from the owner. If you pirate something you otherwise wouldn't pay for (no matter what reason), there is no victim, and I don't think it's wrong.
Now in the case of me pirating a game I would otherwise eventually buy because it gets a very late European release due to stupid policies, there are victims, namely Nintendo and the publisher. I however don't think it's unfair because these are the consequences of their consumer unfriendly actions. As I said, if they didn't have these dumb policies and I could buy the game from the EUR eshop now, or from the US eshop, I would. Me pirating is against the law, but that doesn't necessarily make it immoral. If you think something illegal is always wrong because it's illegal, you really have a few steps to make in your moral development.

You can't sugar coat it any other way. You are a pirate, accept your title and move on.

Maybe. If homebrew can run on it and said homebrew makes use of the extra capabilities then it is a strong possibility. Especially if there is a decent video player with 3D playback.

Nope. I won't buy it.
I have got 2 3ds xl and 1 3ds with capture card.
If I manage to sell the pokemon 3ds xl for a good price then maybe I will buy the new 3ds. All with latest update so no gateway involved.
