no that if they push a fw that have known to have hacked and or pirated to burn all efuses at once to prevent another upgrade on that switch (perfect example is release the said firmware 2-3 months ahead of Pokemon and put a manditory fw update at release and on the game card) without the efuses you can't update so you can't play Pokemon as punishment)
as for a court battle they may ask for the switch in question and run checks to see if it's hacked or not thus your argument is invalid and case will be thrown in the garbage can

Piracy is also an issue, but pirates are going to pirate. You can still play games, update games, etc, you just can't use their online services. It would be out of character if they deliberately sabotaged your console, making it impossible for you to give them money.
