risk of ban with save file for game i don’t own?

to catch darkrai in pokemon arceus you need a save file from brilliant diamond/shining pearl on ur switch. if i have a legit copy of arceus and inject a 100% legit empty save file from brilliant diamond, which i dont own and have never played on my switch, into my sysnand using jksv on cfw sysnand so that i can catch darkrai on my legit copy, is there a risk of ban?

alternatively would it be safer to rip the save from my cfw sysnand, move it to my emunand with a pirated copy of brilliant diamond, catch arceus, and then inject the new save file back into my sysnand?

yes, there is always a risk and especially with pokemon saves

Game Freak and Nintendo are very good to catch the saves that aren't fully created by you, so you need to be offline entirely when play Pokemon games.
