so if Im playing a legal copy with my CFW I should get banned, thats ur opinion?
Yes, that's exactly this. Even if you're not using cheats or anything. Sony has the right to keep you away from PSN.
Well, maybe in Brazil, but not over here in Europe.
So Brazil must be an eldorado for Companies like Sony and Microsoft.
anyway, I would love to hear your explanation, how it can be legal in Brazil to ban people from a network, because they made a software modification on a piece of hardware they bought.
Its like Microsoft saying: "u can only use ur PC with Windows, if u install as your second OS Linux, ure a bad customer and we will stop to provide support"
or an Telecom saying: "U can only use our Network with an "Vodafone/Orange/O2/T-Mobile etc." branded Mobile Firmware, if u install on ur Device android we will ban u."
nevertheless I understand if Sony blocks people, for using copied games.
But everything else is, in Europe and in my opinion, not legal.
"your opinion" does not constitute law. And regardless of your location, you agreed to the PSN TOS which explicitly states that Sony reserve the right to ban you from their services if you use any unofficial or unlicensed software or hardware, including "circumvention devices" etc. So yeah, you AGREED to that when you used PSN for the first time (and probably several more times after that seeing as they keep updating it). It is nothing to do with the law really. It is to do with the provision of a service. For example, with a warranty. Generally, a warranty will be void if you were to say, pour lighter fluid over a device and ignite it, then smash it repeatedly with a sledgehammer. i.e. you violate the terms of the warranty were is says something along the lines of "not valid for deliberate damage to device". They have no legal obligation to continue to provide the service (warranty), because you voided the terms of the agreement. Same thing here. Stop complaining. Just because what you are doing is legal (no laws I know of against burning your own property [safely] or smashing it with a sledgehammer), does not mean that any service the manufacturer usually provides must legally be available to you. And yes, it is the same thing.
First of all, I don't have the CFW. I hate Softmods!
Second, its not true what you say and its not only my opinion but our laws.
Even if I would agree in it, Sony is not allowed to force u for anything regarding ur property.
I remember Microsoft doing it with Flashcards for the 360. They banned Flashcards from Hama, Hama went to Court, won, and got a lot of Money from Microsoft, so they agreed to stop manufacturing this cards. Not very cool of Hama, but hey!
BTT: As Sony is forcing this agreement, in front of a court they would not have many chances, as long as u can prove u didn't play a copied game.
Its like agreeing in the Sony Rootkit of 2003, u had to agree on it, but the end of the Story was that Sony had to remove it and to pay a lot of money over here in Germany (BMG had a least).
Besides, in France, Italy, Germany and Sweden u can, for example, make 5-10 copies of your CDs and give it to your friends, as it is ur property... just an example.
This might just count on the European Continent, not in England, but Im pretty sure, we have around the same laws.
