Not with waithax. The method you linked to is only by doing a system transfer from another 3DS which already has CFW. Waithax requires one of four particular DSiWare games which have all been taken off the eShop.
Oh, I see. I was going to buy one of the games but I wasn't sure where I should buy it from. Can I downgrade my N3DS with the method I posted?

Yes, but you'll need to have a second 3DS that already has CFW installed, so that you can install dsiwarehax on it and perform a system transfer from it to your N3DS that you want to downgrade. Read the guide.

I have a 2DS with Luma. I'm thinking of installing A9lH. Just to clarify, I buy the DSI game on my CFW?

I have a European New 3DS w/ A9LH and a newly bought Japanese New 3DS XL @ ver 11.0 - System transfer won't work, since both are from different regions. Of course I didn't buy the DSiware games on the new one yet.
Looks like I will have to go the hardmod route? Or can I somehow install the DSiware games through the homebrewchannel / FBI / Freeshop? (Though for freeshop I'd need to setup Luma CFW, right?)

You would have to hardmod. You cannot install a necessary DSiWare game (and hax) on the JPN 3DS, as that would, as you said, require CFW, defeating the point of having to get a DSiWare game in the first place.

Alternatively, you could get access to yet another JPN 3DS which already has CFW to system transfer from.
