They'd actually ban people for hacking their device locally? I mean you'd have to try to snatch a digital title (a la freeshop on 3DS) to earn a ban no?
The best advice everyone is giving homebrewed users right now is to simply stay off the grid (as in, have their Switch offline).
We don't know what data Nintendo is getting and what they're actively looking for.
To my knowledge, we also don't really know what's causing those bans yet...

At the moment there's too much rubbish data left behind, which can be used to ban people. That's why so important understanding that what is available at the moment is incomplete and just for helping to developers. People is not taking enough care or consideration.

Oh I'm staying offline right! But what bugs me is that Nintendo isn't actually taking a step now that things are developing fast.
And you're right no one knows what they looking for. For the hackers banned people thought CDN tool but there are many others who have used this tool that are not yet banned though.
Or are they compiling the list of people to ban?:O

Well, that'll just disable certain telemetry. But not all.

Error logs are still being sent to Nintendo - and if they see anything being off with them, they'll just flag you to be part of the next ban wave :P

So, how effective is this method? Is it the same method that gets cracked by all those torrents for pirated programs?

Probably not. It's too easy to create a key that can be verified as genuine, when software can have a keygen created then they just weren't trying. Probably to save money, it's no point spending money to secure your software if few people who might buy it but then decide to pirate it.

TX know that their customer base is mostly pirates & if they don't protect it then they won't sell very many at all.
