Hacking Question Updating games not possible without updating the system right?

Just got a switch on 2.3.0 and would like to play locally with my friends who updated.

The reason it's not possible is the eshop does a check to see if you system is on the current firmware. I'm assuming the switch then gives a unique response to the server that all switches have on that firmware. If the response doesn't match what the current update comes with, then it just denies access. in other words a pretend example is 2.0.0 gives a response to the server aqaqv. The server then checks if it's correct. However when update 3.0.0 comes around its qaqav. And the 2.0.0 response doesn't match, causing the system to not be able to download or play on the web. Course it's probably not that simple. And It's probably not the way they check, maybe it is. I don't know.
