DYKG's "Heroes of Hyrule" video about a cancelled DS Zelda taken down by DMCA from Nintendo.

Did You Know Gaming (DYKG) has been a prominent journalism YouTube channel when it comes to everything gaming, focusing on a wide variety of gaming topics, like unannounced projects, rumours, beta content, cancelled projects, exclusive interviews with developers, unreleased artwork, and much more.

Back in October 2nd, 2022, Did You Know Gaming released a new video about a previously cancelled and unannounced DS game focused on the Zelda franchise, titled "Heroes of Hyrule". The premise of the cancelled game was that of a spin-off in the Zelda series, with a tactical RPG emphasis for its gameplay. The story would focus on a variety of characters and races from the Zelda franchise while they work their way towards a common goal. The game itself was going to be helmed by none other than the team behind Metroid Prime, Retro Studios. However, the project ended up getting cancelled in the design stage.

On December 8th, 2022, DYKG reached out through Twitter with an email received from YouTube regarding a strike on their channel sent directly by Nintendo of America, claiming it on DMCA grounds as copyright infringement.

DYKG mentions in their tweet that they will be "exploring all available options to restore the video" on YouTube.

Come on guys, are you really preserving a youtube video? Youtube videos are usually click grabs for advertisement money. The theme of this video seems to be a rejected pitch from an American company to Nintendo, why it is even important? I bet Nintendo already said no for hundreds of pitches just this year. This is not video game preservation. You don't go to a train museum to see refused train lines that do not even got pass the project phase, that's what I'm trying to tell.

But I can be wrong, as I did not watched the video, maybe it's a masterpiece or whatever.


I wonder if it's a fake or real. I remember some dude got a false strike
The system is indeed messed up. Few months ago a company claimed the lofi girl video without owning absolutely anything. Youtube just accepted right away and removed the video. That said, It seems its really a Nintendo of America claim, because it's a very common practice of them. DMCA is their thing after all.

I have a really hard time to believe this DMCA would hold up in court. I hope they try to take it to court.
It would based on music rights. Music licensing in America is extremely strict, to the point that even a handful of similar notes is grounds for suit. If they used any BGM’s, that’s grounds enough, sadly. If they removed music from the video, Nintendo wouldn’t have a leg to stand on as the work is clearly transformative.

Downloaded the video for safe keeping and offline viewing later. But I did notice it contained Kakariko village's music theme from OoT, maybe that's what caused the takedown.
so just re edit the vid and see them try to take it down then if they do drag n to court over violation of first amendment

The problem with everyone being a citizen journalist (read as: monetized Youtuber) is that it leads to people who are stunningly ignorant of the law breaking said law and then acting like they are the victim. I can see that almost all of you disagree/don't understand but Nintendo is right here and "game preservation" is hilariously used as the catch-all excuse for all sorts of illegal activity. If you people really feel so strongly, boycott Nintendo. Don't just blast them for defending their IP rights, actually stop supporting them. Just as not exercising your right to vote means you implicitly support whoever wins an election, your purchases mean you agree with what that corporation does. You have the power to make Nintendo change. If you don't utilize it, all this tough talk about N hating their customers is just silly as their customers clearly love and continue to support N.

I disagree. Not exercising your right to vote can mean many things: you couldn't vote because you're sick or imprisioned, you don't like any candidate or even the system. The same way, preserving videogames or downright pirating them may or may not have a political connotation. As for myself, I'm pretty disgusted with the industry as a whole for many things sruch as microtransactions and digital-only games so I lure here to discover fun projects and engage in debates.

i have a feeling like they mainly removed that for reasons of brand protection, as it apparently wasn't made public for a reason, and because the video journalism was probably based on gigaleak information?

it's not like they couldn't afford to pay a lawyer for a couple months to see where that goes. dykg has to be profitable.
it's more of they probably dont really care to put in that much work
