To answer your question, there has not been any News of the United States Government working with Nintendo to scan Airports for hardware; if there were, you can rest assured it would make the Front Page here for several weeks, at least.
That's not to say your concerns are unfounded; Microsoft in South East Asia did work together with Governments to scan Airports for Original Software and people were stopped and checked. They might again.
Some might argue that there's little chance of this going to Court, but that's besides the point; being detained long enough to miss Flights, especially on International Transits is enough to ruin your day and within the authority of the Airport Staff.
