Monster Energy fail in courtroom battle against Capcom and Pokémon Co over the use of the word 'Monster'

In a legal battle that was over as quickly as it began, Monster Energy went after Pokémon Co. and Capcom over their use of the word ‘Monster’ in their trademarks. As to be expected the complaints were dismissed pretty much instantly

Monster Energy’s trademark disputes were filed in Japan, where they were squashed soon thereafter. Monster Energy are on a bit of a trademark tirade at the moment, as they have filed a whopping 100 complaints in Japan against numerous companies that use the word ‘Monster’ in their products.

This was nothing new as Monster Energy has been doing this for quite some time, and have become well-known to be a bit of a troll on this topic. Even after losing their battles against Capcom and Pokémon Co., Monster Energy continues to file more complaints against other companies. Monster Energy argues that the use of the word ‘Monster’ in other names/products could confuse consumers. It would seem the legal powers that be disagree.

Of course, they are doing it in countries that don't speak native English. Unfortunately for "Monster Energy", Japan knew about the word "monster" before that trash entered the market.
Exactly it's not like the word hasn't been in use for hundreds of years lol.

It's in the interest of these companies to become as tyrannical as the law allows them. Who trademarks an apple?
That does bring up an interesting point I only just thought of reading your reply. Why hasn't the UK company Apple Corp that was started by members of the Beatles in the 60s and is still going today sued the American company of the same name lol the logo is pretty much the same as well (not surprising really it's an apple).

They’re going after a small dev too. Unfortunately it’s not an April Fools joke…

Monster should be fined every time they lose… heavily. The more they pull this shit, the steeper the fine.

They claim it was for creative reasons, though why the change in September (this being post E3 and equivalents, and probably have run ads for a long time now) for a game that launches in December (and was previously delayed apparently due to another game)... backing down from that kind of existing marketing is a strange thing to do.

Trademark case law says that if you don't defend your trademark with a bunch of lawsuits like a hysterical chihuahua, you can and will lose it. Especially when it's a common word or phrase. If they didn't sue anyone with "Monster" in its name, they would lose the trademark and anyone could start producing "Monster energy" drinks. This is just going through the motions. It doesn't matter if they lose, the record will show they are defending the distinction of their trademark.
