I have made threads from a 2ds before so it's not impossible that they posted from an o3ds
Probably not. The N3DS has better hardware so it can decode video. You can always try and install the browser .cia file from an older firmware dump like 9.2.0-20 (see this post for more details as to which you'll need). It probably won't work, or even worse it may brick your 3DS (make a NAND backup first!)

Agreed, that why I try to buy all my games on disc, Xbox anyways. Switch games (which I pirate tbh) don't matter much, I stay offline 24/7 anyways.

You can buy drm free games / music / ebooks, and if you keep backups of your data (like documents and family photos etc), then you shouldn't lose the game. but with a disk, your toddler could put it in the toaster and there goes your $60
