I just wonder why Nintendo isnt sueing Xecuter because what they are doing is illegal right?
Why isn't apple suing saurik for making cydia...

It's not what's being made that's the issue it's how the end user is using it.

They are technically a backup loader. They are not selling you the roms nor making them available. It would be like nusic and movie industry suing manufactures of CD and DVD writers because people COULD make pirated copies.

Illegal in the US and EU, elsewhere it's more complex.

Nintendo will go after the companies importing them, if they can identify shipments then they'll have them seized.

That is what they did for DS flashcarts. They sued lots of importers.

If they didn't use any Nintendo code then it's not illegal.
There are more crimes in the world than stealing code. (For example, going to your house and stealing your food)
So, in some jurisdiction, maybe possibly Nintendo could sue TX, for something that isn't stealing code.
I'm not sure of the laws, but there are so many of them I bet one or two could be used as a good momentum for a legal case :)

Big N sued several people/groups, some with succes, some not. Lawsuits take time and money to prepare and really take a lot of time to get a result.

And look at how much of a success Nintendo was at that too.

TC thinks Nintendo can just sue TX and this will disappear but really it won't, it will make matters even worse for Nintendo, this is why Microsoft allows homebrew onto Xbox One X and such, they have realised it's better to reach out than to completely fight hackers head on over and over and I know Xbox One is hard to hack but who needs to hack it when you can use homebrew and retroarch on it without hacking it.

Probably depends on the CFW/OS. If they use Nintendo code they could probably work to block online distribution too.
