can I safely update my 3ds roms
*installed 3DS games, yes you can install updates for your installed 3DS games, either through the eShop, or downloading/ installing them manually.
and my Nintendo
Yes you can update your system if you have CFW installed, just update Luma3DS first to the latest version, and install the 3DS firmware to the latest version.
if won’t banned or whatever right?
No, the only ban risk these days is cheating online, or messing around in the eShop like using fraudulent credit cards there, asking for refunds for illegally owned games etc.
Some are jap roms
Well you can't update them through the eShop if your system is not Japanese, or is region changed. Though you can always install updates (from the internet) manually through FBI.

I'm retrying the download (The error only shows after the bar is full), so Ill post an update in a bit, Thanks!
Try a different source. Or are you downloading it with FBI (through QR code)? If so, that could be the cause of the issue, specially for large games.. I would suggest downloading it on your pc and copy/pasting on the sd card instead.
If not, could be faulty or defective sd card, and once it surpasses its true capacity it won't write any correctly to it..

I'm not sure if it was Luma, the only thing I remember is that if I removed the SD card, it booted like it was an "unhacked" console
This is unclear. Luma normally boots like an "unhacked" console even with the SD card inserted.

Since then, the console firmware (v.9)
Also, there is no v.9.

Everything went smooth... until I remembered I didn't export my CIA save files.
Installing Luma never requires you to export your "CIA save files". What exactly did you do? If you formatted your console, then updating Luma does not require that.

Ok, so you installed cfw now right? Did you format the system when you installed cfw? If you did, check this thread it should help.
That's normally good advice, but if the system has been formatted, then the encryption key has changed and so has movable.sed. Recovering an old encryption key after a System Format is possible using https://gbatemp.net/threads/release-godmode9-scripts-megathread.482150/page-9#KEY_Y .

nope. Does the console show any errors of any sort when said issue shows?
Heres the error (Sorry for poor image quality)

No, things like that will not affect System Transfer. People regularly do System Transfers with CFW; all you need to do is install CFW on the new unit and run Faketik.
Ok, my repair guy said he is not doing a system transfer but he thinks the new mother board has homebrew too. There is an icon that says Dev Men on it. Does this mean it’s a developers unit? Is it safe to home brew update? Or is it maybe some dev menu installed on a retail system by way of home brew?

yeah, dev menu is quite old like big blue. iirc, they're like fbi in that they're cia installers. it's like decrypt9 or hourglass, which predate godmode.

Ok yeah, I did see a big blue download when I searched for info on it and the repair guy made it sound like it was just a cia installer. So I guess the homebrew on this device is pretty old. 3ds guide website should guide me safe through everything to update it right? No risks I should be aware of

http://3ds.guide/checking-for-cfw

I expect this is old enough to count as "unhacked".
Yeah I got it back and it has luma on it. Latest version judging or at least as new as a few weeks ago when I updated my other one. It also has boot 9 strap. It looks like dev men is injected in to the health and safety app. It seems like a dangerous kind of program, how do I get health and safety back? is that a part of the 3ds guide anymore? Does godmode9 maybe just restore it?

....I finished the guide and didnt see anything about it. I tried in GM9 but it said I don't have H&S backup to restore. Can I get H&S backup from my other 3DSXL system and restore it on this one safely? .....NV I didnt check it, I guess its gone because of some step in the guide I followed, probably the system update I guess......

BUT.....fake tik did not make all my games on my SD card from my previous mother board appear. Do I just need to delete them with the PC to make room on the SD card?

I have a modded Nintendo 3DS. I installed a game using a CIA file and GodMode9. I see the following notification when I hover over the game:

"Distribution notification: The scheduled release date for the purchased item has passed. Launch this software while connected to the Internet to check distribution information."

Why does this appear? Is this an "unreleased" title? Will I get banned from the eShop if I play the game?

Also related: The file has been verified okay by GodMode9, but I'm unable to successfully dump the CXI file of the installed title using GodMode9.
