Is that a bad thing is it?
As far as i know, you are able to share/distribute files that modify A system, only if those are created without any copyrighted code on them.

The problem with that is that it doesn't modify the system but it's a modified part of the system that we "re-apply". So we took the kernel, changed some things and now boot that modified kernel

So business as usual, indeed business as it has been for decades at this point. Maybe not as kernels for some of the older focuses of things on this site (mainly as they were too primitive to have a kernel) but functionally no different when all is said and done.

While I couldn't give two shits about Switch backup loading, why are people bitching about piracy on a site that used to promote piracy?
Since people already seem to not get this post - TL;DR Do your piracy but remember that it could always lead to others that did nothing wrong getting bad karma because they get associated with piracy!

The patch is being distributed in the form of a pre-patched kernel file, rather than as a diff-patch for an unmodified copy of the file - as most ROM hacks are distributed -, which could be considered copyright-infringing and be grounds for a DMCA.
Granted, said ROM hack patches would also be using copyrighted formats and so-called "Illegal Numbers" in their creation and distribution, but I guess it's more of a legal slippery slope.

I've been in the gaming scene since the 1980's. My first games for the TRS-80 were pirated. My C64 games were pirated. In fact, all my computer games pretty much have been pirated since the 1980's. Only was able to start pirating video games when the PSX came into play.

You know how many companies folded because there products were pirated? None of them. Pirating has been a part of society for a long time. It doesn't hurt sales unless the publishers do stupid tricks like limited releases, or not doing all formats.

Why doesn't pirating hurt sales? Because the number of pirates are very fucking small compared to the number of people who pay for content.

Cant you just request your name to be taken out of the credits? Or make them say something in the credits like, "this modified version is in no way associated or approved by the original developer(s)." I know not everyone would do it but its better than nothing, I suppose...

Also, releases and piracy have been here since 1982. Back then, it also meant phreaking because mom and dad weren't going to pay the long distance charges.

This isn't new or shocking. If you're surprised, you're stupid.

Now if that had been said from the beginning then we might have started to get somewhere. Indeed such things were a problem at the start of the wii (and then someone did a diff on an encrypted file, finally we got an installer like most would know them today).
Hopefully someone fires up xdelta or something and redistributes accordingly.

Also is that illegal numbers? I thought those were mostly primes that you could twist back into a program that did something illegal (the stuff with decss being the main go to example for most).

If morons want to associate the actions of others with those neither doing them nor commanding them then that is their problem.
