If you buy a switch on the internet, you have zero indication as to what firmware it will be on asides from what the seller claims.
It is more reliable to check in store: try checking the serial number on the console in the box (there is a hole cut in the bottom of the box for the serial number to show through) and referring to this thread to determine which firmware the console is running. However, if your store moves stock quickly, it is likely the only stock they will have is more recent releases. If that's the case you will have to take your chances with the scalpers.
