Even banning the cart itself may not be that easy. Let's suppose i buy a used game, the previous owner dumped it but never used the dump. My original cart works online for a while, then the previous owner decides to use the dump and my cart suddenly gets banned for no apparent reason. i contact nintendo and they say the cart was banned because it was copied and is being used on more than one system or something like that.

From a legal standpoint i did nothing wrong, i have a genuine cart with a genuine license and the legal rights to play that title.
There is also no way to verify if a cart might be banned or dumped before purchase.

Legally they can do this, but I think practically they would not because they will have to deal with one frustrated customer per each one instance of piracy. It makes the cure worse than the disease.

This is why I bet they only go after games that get hundreds+ duplicate IDs because they are being shared online. That's one frustrated customer to curtail the really widespread piracy.

You're signing a contract when you buy digitally but physically ? They can revoke online access for sure, but for an offline game that seems weird. I'm pretty sure that would be 100% illegal in Europe.

Wouldn't that also be included inside the TOS you agreed to when you created your Nintendy account.

No online no updates. Most game cart don't fully function nowadays. It is very rare that there isn't a day one patch. The worst case may be like MK1, only demo is available without the update.

I don't think you absolutely need to create a Nintendo account to play Zelda for example, and then if they were to actually ban you from using a cart you've bought, I can imagine the story being taken up by regulators.

I mean, when I bought Overwatch 1 on PC or whatever Steam game that had a plastic case, it was mentioned I needed Steam/Battle.net etc. In those cases it's pretty obvious I dont own Arkham City or Overwatch 1. But what about my Breath of the Wild cartridge ? As long as there's no need to use a Nintendo account I don't see how they could legally prevent me from using my cartridge even if I just bought it used but haven't done anything to it.

Absolutely, that's why you most likely just own the thing « as is » and tough luck if the game is unplayable without a patch, but a lot of times it is so I don't see how could Nintendo legally prevent you from playing a 1.0 game, wouldn't it make a pretty huge precedent ?

(as an evil company, I would just release a firmware modification for all the flagged consoles and disable the cardreader. If someone complains, the standard support answer would be that a non licensed cardridge corrupted the drive)

As stated several times now, this device is not conceived for piracy, is only to RUN YOUR OWN BACKUPS period.

In theory, if you did this offline, then ejected the cart, then went back online, wouldn't there be red flags transmitted that you did this? Telementry saved and sent? (ban) I know it all speculation still right now.

Yhea, the tlemetry will tell to N each little thing you do on your(Their) console.

we don't know yet. I honestly think so since they upgraded the telemetry since the SXOS days
