I am in the middle of doing some text tests for the Nintendo DS, using Nightfox's Library in order to see which fonts I could use for a future game. Does anyone know of any fonts that work well with the Nintendo DS? Nothing too out of the ordinary, but one that is more basic, and 8x8 or 8x16.

for system fonts maybe this thing will be useful - dsFont
The scale method maybe not best method for most of ttf fonts, but you are getting something original...
on the web you can find ripped 8x8 fonts from the most of classic games.
or maybe you want to make one or modify existing ones, it's just an artwork that may be also good to spend some time on it.

https://www.romhacking.net/fonts/ might be of interest.

I will also note Crystaltile2 can do fonts, both wholesale conversion and individual fonts though I do also find a lot of modern PC fonts struggle with things when they get to console sizes.

Wouldn't I get in trouble if I used those in a commercial homebrew game? I'm assuming those aren't freeware, or maybe I'm wrong.

That might be poking the bear, and you could well end up having to justify things even if they are renditions of now ancient typefaces.

In that case https://www.fontsquirrel.com/ might yield something you can feed to CT2 (it had an option to take and generate, and in the tile viewer or possibly editor if you type it will put the currently selected font in the location (though again many things have trouble when it gets to 8x? sizes.
